Lincoln Electric System (LES) is offering this online portal as a convenient option to our valued customers. In addition to these Terms and Conditions, you should review the online portal Help section for frequently asked questions and our online portal Statement of Privacy. The Help page includes information about how the portal works and how to get help if you have a problem using it. Our online portal Statement of Privacy includes important information about the type of information we collect, how we collect it, and what we can do with that information.
Authentication and authorization for online portal usage
- The online portal uses industry-standard methods to validate the information that you supply to make a payment through the portal.
- Upon your acceptance of these Terms and Conditions, as a portal user you are responsible for any legal, regulatory or banking penalties and fees that may be assessed for supplying false banking account and/or credit or banking card information for use in the online portal.
- The online portal may be used for payment on both residential and nonresidential accounts. Please refer to our Service Regulations, Section B.4.1 for customers who are eligible to pay by credit or banking card. All customers are eligible to pay by ACH.
- If the payment option is a banking or credit card account for your business, then it must be one for which you are a properly authorized user.
- By accepting these Terms and Conditions, you authorize LES to initiate a charge to your designated account or card, according to your instructions. Each time you use the online portal to pay an LES Bill, you will be reauthorizing us to charge your payment option.
By accepting these Terms and Conditions, you represent and warrant that:
- You are 18 years old or older.
- You are using your actual identity, and any information you provide is accurate and complete.
- You are legally authorized to make payments using your payment option.
- You have read and agreed to our online portal Statement of Privacy.
- You have read and agreed to the LES Service Regulations.
- Your use of the online portal will not violate any local, state, national or international laws or regulations.
- Inappropriate use of the portal may result in the revocation of access to the portal.
- If using the online portal for your business, any individuals within your organization who are given access to the portal have been provided with these Terms and Conditions.
Payment service
By providing LES with the account information for your payment option, you authorize us to follow the payment instructions we receive from you through the Service.
When you use the online portal to send us a payment instruction, you authorize LES to initiate a message to your bank or credit card provider to charge your account and to send those funds to us for payment on your LES account so that we receive the funds as close as reasonably possible to the date indicated by you in the payment instruction. If your payment is received after the due date of the bill, regardless of any cause except for our failure to reasonably process your explicit payment instruction received by us, then you will remain responsible for any fees or interest assessed, the same as if you mailed your payment to us and we received it after the due date. This would be true even if you are unable to access the system due to problems with your internet service provider or if our online portal is temporarily unavailable. Therefore, we recommend that you enter payment instructions that initiate each payment to us at least four (4) business days before the actual due date. (Business days are Monday through Friday, except for federal banking holidays.) Any payment instructions received after 5 p.m. CDT will be effective the following business day. Likewise, any payment instruction received after 5 p.m. CDT on Friday up through Monday of the next week. It is the day we receive payment from you, and not the day we receive your payment instructions, that determines whether your payment was timely received.
Limitations of liability and exclusions of warranties
Alterations and amendments
These Terms and Conditions are the legal binding agreement between LES and you with respect to the online portal. You will be agreeing to the current provisions of these Terms and Conditions each time you access the portal. These Terms and Conditions may be altered or amended by LES at any time. Your use of the online portal after any changes to these Terms and Conditions will constitute your agreement to such change(s).
Termination or discontinuation
We reserve the right to discontinue use of the online portal at any time or to terminate your use of the portal. If we terminate your use of the portal, you will need to complete business transactions, including payments, either in person, by mail or over the phone. Options can be found at LES.com/Pay.
Disputes
If there is a dispute regarding payments made using the online portal, you agree to resolve the dispute in accordance with the dispute resolution procedures and governing law as outlined in your payment option’s Credit Agreement.
These Terms and Conditions are the exclusive statement of the agreement regarding the online portal between you and LES. It supersedes any proposal or prior agreement, oral or written, and any other communications between you and LES relating to the portal. If there is a conflict between what an LES employee tells you and the terms of this document, these Terms and Conditions will prevail.
You may print and retain this document for reference, or it is available at any time within the online portal.
